1. Introduction
SPERANZA is an online marketplace where individuals can book unique, luxury experiences provided by independent service providers. By accessing or using our platform, you agree to these Terms of Service. If you do not agree, please discontinue use of our services.
2. Service Description
SPERANZA facilitates the booking of experiences offered by independent service providers ("Experience Curators"). While we carefully vet experiences and curators, SPERANZA does not control or guarantee the quality, timing, legality, or fulfillment of the experiences. Our role is solely to connect users with independent providers and facilitate the booking process.
3. User Obligations
By booking an experience through SPERANZA, you agree to:
Provide accurate and complete information during the booking process.
Comply with any additional terms and conditions set by the Experience Curator.
Attend the booked experience at the scheduled time or communicate changes promptly with the curator, subject to their policies.
4. Independent Service Provider (Experience Curator) Obligations
Experience Curators are responsible for:
Delivering the experience as described on the platform.
Responding promptly to booking requests and communications.
Fulfilling the booked experience within six (6) months of the user's initial attempt to schedule it.
5. Cancellation and Refund Policy
All bookings are final and non-refundable unless otherwise required by law or deemed appropriate under special circumstances by SPERANZA.
Changes to bookings must be communicated directly to the curator and are subject to their terms and availability.
7. Liability and Insurance
Experience Curators are solely responsible for obtaining necessary insurance and assume all liability for incidents, damages, or injuries arising from the provision of the experience.
SPERANZA is not liable for any claims, damages, or disputes arising from experiences booked through the platform. Users and curators are encouraged to resolve issues directly.
8. Governing Law
These Terms of Service are governed by the laws of the State of New York, without regard to its conflict of law principles.
9. Miscellaneous
Force Majeure: SPERANZA is not responsible for delays or failures to fulfill its obligations due to events beyond its control.
Severability: If any provision of these Terms of Service is deemed unenforceable, the remaining provisions will remain in effect.
